President Ruto suspends ‘Cherera 4’ from IEBC, forms probing tribunal

President William Ruto has suspended the four embattled commissioners from the Independent Electoral and Boundaries Commission (IEBC).

In a gazette notice, the commissioners led by Vice Chairperson Juliana Cherera, Justus Nyang’aya, Irene Masit, and Francis Wanderi, will remain out of the office while a tribunal led by Justice Aggrey Muchelule conducts investigations.

This comes after the President received a petition from the National Assembly calling for the dismissal of the four.

The notice states that the transmittal of the petition is predicated on the National Assembly’s determination that the requirements of Article 251 (1) of the Constitution for the removal of a member of a Constitutional Commission have been met.

“Having received and considered the petition of the National Assembly and in exercise of the prerogative vested in the Head of State and Government by Article 251 of the Constitution, I, William Samoei Ruto, President and Commander-in-Chief of theKenya Defence Forces, do hereby direct as follows: that, Juliana Whonge Cherera,  Francis Mathenge Wanderi, Irene Cherop Masit and Justus Abonyo Nyang’aya, being members of the Independent Electoral and Boundaries Commission, be and are hereby suspended from office with immediate effect,” the notice reads.

Other tribunal members include; Carolyne Kamende Daudi, Linda Gakii Kiome, Mathew Njaramba Nyabena and Saeed Khamis Saeed.

The joint secretaries of the tribunal are Kibet Kirui Emmanuel and Irene Tunta Nchoe. The Lead Counsel will be Peter Munge Murage, and the Assisting Counsel will be Zamzam Abdi Abib.

The tribunal has been tasked with reviewing the petition and looking into the allegations made in it in order to remove the four commissioners.

It shall then prepare and submit a report with recommendations and use all the legal authority granted to it for the proper discharge of its mandate.

The petitioners claim the four lack the authority to serve as IEBC commissioners and want them removed from office for flagrantly violating the Constitution and breaking their oath.
