Petition filed in court challenging President Ruto’s PSs list
A petitioner has filed a legal challenge against President William Ruto’s list of nominated principal secretaries, citing ethnic imbalance.
The petition filed at the High Court by petitioner Fredrick Bikeri aims to prevent the National Assembly from approving the 51 candidates for the positions.
According to Bikeri, the nominees only represent the communities that are becoming beneficiaries rather than the face of Kenya.
Via his lawyers Dunstan Omari, Shadrack Wambui, and Paul Macharia, the petitioner claims that the nomination did not include individuals with disabilities, and lacked regional diversity, or gender balance as required by the constitution.
“That the said list of persons appointed to the rank of Principal Secretary does not reflect nor ensure gender balance, regional balance, tribal balance, inclusivity of the marginalized, contrary to the tenants of good governance as demanded by Articles 10, 54, 55, 56 and 57 of the Constitution of Kenya 2010,” the lawyers submitted.
The petitioner claims that only two of Kenya’s 44 tribes are represented by the nominees.
The lawyers are pleading with the court to avert the parliament from receiving 51 nominees for vetting until a proper nomination process is completed.
The petition will be placed before a constitutional court for orders and directions.
A vetting timetable shared on Friday, November 4 by the Clerk of the National Assembly Samuel Njoroge shows that the list of PS nominees is scheduled to be vetted by the National Assembly’s departmental committees between November 14, and November 18.
Members of the public have at least three days to present their views before the approval debate begins.
