Two-thirds of death row inmates battling physical, mental challenges – report

A new report by the Kenya National Commission on Human Rights (KNCHR) has shown that two-thirds of prisoners on death row in Kenya are battling physical and mental health challenges.

The report, titled “Living With a Death Sentence in Kenya: Prisoners’ Experiences of Crime, Punishment and Death Row,” has found that 67 percent of inmates sentenced to death over robbery with violence and murder said their physical health had suffered compared to those whose death sentences had been commuted and who were now serving a life sentence (63%).

A total of 671 prisoners spread across 12 Kenyan prisoners participated in the survey.

“Some time away from death row may have improved their health, though the difference was not statistically significant,” part of the report reads.

The survey also revealed that 63 percent of the inmates interviewed said their mental health had suffered since going to prison.

“This was a little higher for death-sentenced prisoners (65%) than for those now serving a life sentence (57%),” the report added.

There were no differences between men and women reporting on their mental health.

“Two-thirds of the prisoners said that their relationships with families had deteriorated following their conviction, with 1 in 10 having no visitors in prison,” the report further stated.

The report also highlighted that the majority of those sentenced to death (56%) were convicted of robbery with violence with 44% of murder.

“Most were poorly educated. More than 1 in 10 had never been in formal education and more than 2/3 had only completed primary school,” the report added. “Fifteen per cent reported that they had been experiencing mental health problems, higher than the national average,” it added.

The study revealed that only one in 10 was in permanent full-time employment, and “their average wage was below the Kenyan minimum wage.”

The report also added that most prisoners (89%) were responsible for supporting dependents.

“More than one-third were in debt. Almost half (43%) said that they had been relying on alcohol and almost one-third had a history of alcohol or substance misuse,” it said.

The report calls for the Kenyan government to improve the conditions of prisoners on death row and to ensure that they receive adequate medical care, as well as to review its use of the death penalty.

The KNCHR Chairman, Kagwiria Mbogori, said that the report is a call to action, stating “Kenya should take this opportunity to review its use of the death penalty, in light of the findings of this report and the global trend towards abolition of the death penalty.”
