Presidential petition: CJ Koome allocates time to all parties involved

The presidential petition pre-trial conference commenced at 11am, with all 7 Supreme Court judges in participation as announced by the Chief Registrar of the Judiciary Anne Amadi. The Chief Justice Martha Koome has allocated time to each petitioner, respondent and parties in opposition to the petition.

The main petitioner Raila Amolo Odinga and Martha Karua have been allocated 3 hours  while the supporting petitioner John Njoroge Kamau has been allocated 30 minutes. Other petitioners; Youth Advocacy Africa and Peter Kirika, Khelef Khalifa and others, David Kariuki Ngari and others, Okiya Omtata and others, Julia Nyokabi and others have each been allocated 30 minutes.

The respondents, who are the four dissenting commissioners, Juliana Cherera, Irene Masit, Justus Nyamwaya and Francis Wanderi have been given one hour to share among themselves, translating to 15 minutes each if being represented by different counsel.

The parties in opposition to the presidential petition, the IEBC and the IEBC chairman Wafula Chebukati, have been allocated 3 hours to share among themselves. William Ruto and Rigathi Gachagua have been given 3 hours. The attorney general, Paul Kihara, has been given 30 minutes to respond.

The supreme court admitted three amici curiae who will not be given time to make any submissions, instead the court will rely on their briefs which are on record unless the bench raises any issue of clarification.

Chief Justice Koome hopes by the third day of the hearing they’ll hear a rejoinder hence allocating the main petitioner Raila Odinga and Martha Karua an hour to respond. The other petitioners, Youth Advocacy Africa and Peter Kirika, Khelef Khalifa and others, David Kariuki Ngari and others, Okiya Omtata and others, Julia Nyokabi and others will each been allocated 15 minutes.

The supreme court will be expecting a report tabled before the court on Thursday afternoon, if any issues will arise from the same the main petitioner shall be given 30 minutes to respond. Youth Advocacy Africa and Peter Kirika shall have 20 minutes to respond, Khelef Khalifa and others will have 10 minutes with the parties opposing the petition each given 30 minutes.

While concluding her statement, CJ Koome was keen to remind all parties involved to observe punctuality and time allocated for each on the screen.
