Parliament, Executive and Judiciary must respect each other – AG nominee Muturi says
Attorney General nominee Justin Muturi says he will ensure there is mutual respect between all three arms of government if he gets the position.
In his submission to National Assembly during his vetting, Muturi said it is not a question that all the three arms must exercise respect.
“The three arms of government and indeed the devolution units yes there is of the principle of separation of powers which is important in our constitution architecture, but there is also need for each to respect the others,” he said.
There existed a perennial rivalry between the Executive and the Judiciary stems back to the tenure of former Chief Justice David Maraga who accused then-President Uhuru Kenyatta of interfering with his turf.
The former CJ accused the Executive of frustrating his efforts to ensure an independent Judiciary by establishing relevant courts across the country with adequate and competent manpower.
On several occasions, Maraga, who was the president of the Supreme Court, expressed offence by what he interpreted as an attempt by the Executive to assign the Judiciary functions.
The Constitution states that the roles of the Executive, Legislature and Judiciary which are independent but work together in mutual cooperation and respect.
