Moses Wetangula is eligible for Speaker, Clerk dismisses Azimio protest
Just before the 13th parliament cast their votes for the Speaker and Deputy Speaker, seasoned lawmaker Tom Kajwang challenged the candidature of former Bungoma Senator Moses Wetangula.
The Ruaraka MP told the house, “I am reliably informed he tendered his resignation on 9th August. The person he resigned to was already an elected governor. To which speaker did he resign to?”
According to Kajwang, the term of this house expired on the 8th and not on 9th thus invalidating the status of Wetangula’s resignation since there was no speaker to receive his resignation.
“He resigned to no speaker,” said Kajwang.
He further alleged that there is a report that says Wetangula is not eligible to hold any public office over matters arising from matters around integrity.
However, Acting National Assembly clerk, Serah Kioka ruled that Moses Wetangula is duly qualified to contest for speaker.
“On September 5, I wrote to IEBC, and on September 6, they wrote back and confirmed Wetangula is a registered voter in Kabuchai, he is dully qualified to contest for speaker,” said Kioko.
She also confirmed that she has a copy of the resignation letter that was addressed to the Senate Speaker a seat in her words became vacant when the Senate held their sitting earlier today.
Kikuyu MP Kimani Ichungwah had asked Kajwang to present evidence of the alleged letter and report. According to Ichungwa, Wetangula resigned two days after his gazettement.
Ichungwa poured cold water on Kajwang’s argument saying while the roles of Member of Parliament expired on August 8, Speaker Justin Muturi remains in his role until a new speaker is voted in.
“The office of the speaker exists in perpetuity until another is elected. I beseech that we don’t spend so much time discussing things that are opaque and hot air, ” he said.
While referring to Article 74 of the constitution, Garissa Township MP Aden Duale sort to dismiss Kajwang’s arguments saying Wetangula had not taken an oath of office and thus seized to Senator for Bungoma on August 9.
“Since August 9, Moses Wetangula was a Senator-elect, ” said Duale.
While supporting Kajwang’s case, Nominated MP, John Mbadi said only the court of law can change a returning officer’s pronouncement of a candidate elect. He urged the house to consider revisiting the law to create clarity over this grey area.
The casting of the votes for the Speaker of the house has already begun.
