Meru MCAs submit Mwangaza’s impeachment papers to Senate
The fate of first-time Governor Kawira Mwangaza now lies in the hands of the Senate after the Meru County Assembly Speaker submitted the impeachment documents to the House, today December 15, triggering the second phase of the impeachment process.
Section 33 of the County Government’s Act dictates that the house should hold a special sitting within seven days after the receipt of the impeachment documents.
Senate process
The special sitting is to hear the charges the county assembly brought against the governor.
The Senate, by a determination, then appoints a special committee comprising eleven of its members to investigate the matter.
If the Senate decides to appoint a committee, it will have ten days to probe the matter and report to the House whether it finds proof for the charges the accuser brought against the governor.
The governor has the right to appear and to be represented before the committee during the duration of its investigations.
Further proceedings do not take place if the special committee finds no proof against the allegations facing the governor.
If it finds proof, the Senate proceeds to vote on impeachment charges. The vote only takes place after the assurance that the governor receives a fair hearing.
If a majority of the county delegations in the Senate vote to uphold the impeachment charge, the governor ceases to hold office. If the delegations vote to reject the impeachment charge, the Senate speaker should notify the speaker of the respective county assembly.
Mwangaza’s woes
Governor Mwangaza became the first governor to be impeached under the Kenya Kwanza administration on Wednesday, December 14.
Her impeachment was a culmination of a bitter conflict between her and the county legislators.
With 67 of 69 MCAs voting to impeach, Mwangaza’s goose came home to roost with her pride being termed as the source of her downfall. The other two MCAs were absent.
The MCAs accuse the governor of nepotism, illegal appointments, unlawful dismissals, and usurpation of the constitutional and statutory powers of the county organ.
Other grounds include forcible entry into the assembly precincts and the mobilisation of unlawful riots against assembly members, a violation of public financial management law, and malfeasance in the nomination of County Executive Committee Members.
