Mercy Wanjau grilled on her appointment as Ag. Director General at CA
Mercy Wanjau, the nominee for Secretary to the Cabinet, had a difficult time explaining her appointment as Acting Director General at the Communications Authority of Kenya (CA).
Mercy was obliged to defend the validity of her appointment in August 2019 since the board lacked a quorum to make a decision.
She defended herself by claiming that there was a court action disputing the legitimacy of the board of directors’ election and that she had not been appointed at the time. Mercy revealed that when the term of the then-sitting DG Francis Wangusi ended, there was no board.
When asked how she was appointed in the absence of a board, Mercy stated that there was a legal framework for the State Corporations Advisory Committee (SCAC) to take over and make an appointment.
“Where there is no board, the State Corporations Advisory Committee kicks in for purposes of business continuity,” she said.
“I was appointed on exception by the State Corporations Advisory Committee, not the board,’ she added.
She further stated that her announcement was made by the board chair, who was unable to call a meeting since it was inquorate.
Junet then questioned how the then-DG was removed from his seat if the board was not quorate. Mercy justified herself by stating that his time had come to an end in accordance with the law.
When Junet asked why Wangusi’s time was not extended to enable for the creation of a proper board, Committee on Appointments chairperson Moses Wetangula jumped in and said Mercy was not in a position to answer.
Following reports that the Employment and Labour Relations Court had nullified Mercy Wanjau’s appointment as acting DG, CA Board Chairman Ngene Gituku clarified in November 2019 that the Court did not make any finding on the acting DG’s appointment because it was not provided with a copy of her appointment letter.
