Man accused of selling lover’s nudes on WhatsApp for Sh20
A man who seduced a Facebook friend, took her to his house where they recorded videos of their bedroom affair before selling them online to potential customers has been charged with unlawful distribution of obscene and intimate images.
Daniel Orina is accused of publishing and disseminating obscene and intimate images of the woman on his Facebook account on August 29 and 30 in South B, Nairobi, together with others at large, contrary to section 37 of the Computer Misuse and Cybercrime Act of 2018.
Earlier this year, Mr Orina sent the woman a friend request on Facebook. He then sneaked into her inbox and seduced her; they fell in love.
In June, the complainant left her uncle’s house in Kangemi to visit Mr Orina at his home in South C estate, where they had intimate relations, after which he accompanied her to Nairobi city centre where she boarded a matatu back home.
Three weeks later, the woman visited the suspect a second time at his home where they again had relations, but this time they agreed to take pictures and videos of their amorous activities.
After the recording, Mr Orina transferred the pictures from the complainant’s mobile phone, which they had used for the recording, to his mobile phone and accompanied her again to the city centre, where she went back to her uncle’s house.
In mid-August, the woman returned to Mr Orina’s house, this time with the intention of deleting the videos and pictures from the suspect’s mobile phone.
However, they ended up staying together in South C for four days before the complainant left for Kangemi and subsequently blocked him on social media.
After a week, she received a call from a friend asking why she was posting videos and pictures of herself naked on her Facebook timeline.
Mr Orina had allegedly hacked into her Meta account, changed her name and posted that those interested in the explicit videos should drop their WhatsApp numbers to receive the videos for only Sh20.
The suspect had also allegedly shared the video with a friend of the complainant, who is now listed as a key witness in the case.
The woman later reported the matter to Pangani Police Station and the Directorate of Criminal Investigations (DCI) took over the investigation.
The DCI recovered screenshots of the videos and pictures Mr Orina allegedly posted on the account, which are listed as exhibits in the case.
Mr Orina denied the charges before Senior Principal Magistrate Agnes Mwangi of the Makadara Law Courts. He was released on a Sh200,000 bond with no option for cash bail.
The case will come up for mention on 17 November ahead of trial on 4 April next year.
The Facebook account has since been suspended and is also listed as an exhibit in the case.
