LSK opposed to creation of office of the opposition leader
The President of the Law Society of Kenya (LSK), has voiced his strong opposition to the proposed legislation aimed at establishing the Office of the Official Leader of the Opposition.
Under this bill, the leader of the Azimio la Umoja-One Kenya Coalition Party, Raila Odinga, and other future elected officials would gain the authority to appoint their supporters to constitutional and independent commissions. Moreover, they would have the ability to address the nation and Parliament more frequently.
Theuri has raised concerns, asserting that this proposed office is not in accordance with the current constitutional framework.
“We don’t see that position fitting the architectural structure of the Constitution, and it would mean that we need to overhaul the entire Constitution to achieve the creation of that office,” Theuri said while speaking during a morning show on Citizen TV.
Funded by taxpayers, the bill would empower the officeholder to seek additional funding from donors to supplement the budget allocated for its activities.
However, Theuri deems the campaign for establishing this office as unwise, particularly given the challenging economic conditions and high living costs in the country.
“We are going through a very difficult situation; high cost of living, and because of all those considerations, I think that we have to live with the current structure that we have and ensure that we implement our constitution much more faithfully,” he said.
The LSK president further highlighted that the existing constitutional structure aims to lead the country towards a new promise, one that has yet to be fully realized due to political motivations.
“People are trying to claw back on the provisions of the Constitution, attempting to take us back to a majoritarian leadership, where the Head of the Executive becomes above the Constitution,” he added.
Theuri’s comments come as the National Dialogue Committee is considering memoranda submitted on the two-thirds gender rule, the cost of living, political party loyalty, the constitutionalisation of political party funds and an office for the Official Leader of the Opposition, as well as the Office of the Prime Cabinet Secretary. President William Ruto has expressed support for the proposal, highlighting its potential role in keeping the government in check.
