LSK demands more judges posted to Kisii High Court over backlog of murder cases
The Law Society of Kenya (LSK) is calling on the judiciary to send more judges in Kisii as it emerged there are a backlog of cases.
LSK South West Nyanza Branch officials claim at least 92 murder cases are being handled by a single judge as the crunch continue to be felt.
The officials lamented of the delays in the clearing of cases amid an upsurge in murder incidents in the region.
While addressing the media on Monday, January 9, branch chairman Gideon Nyambati said the judge is overwhelmed with the piling cases and he urged Chief Justice Martha Koome to add at least two more judges.
He added that the Judiciary had removed a judge two years ago without a replacement forcing the current one to handle both civil and criminal cases.
“The 92 murder cases is a huge number and cannot be handled by one judge. That is overwhelming,” said Nyambati.
He added, “As a society, we have the legal mandate to discharge a certain obligation to the community, which includes legal representation in court and counselling. As a society, we do not represent the suspects, they are represented by individual lawyers as instructed.”
Just last week, a man in Kiobegi village is said to have beheaded his two daughters causing uproar among the residents.
In 2021, police in Kisii recorded a total of 126 people having been murdered in the county over a period of one year.
Nyamache Sub-county recorded the highest number of murders with 18 cases, Kenyenya had 17, Kitutu Central and Masaba South at fifteen each. Kisii South recorded 13, Sameta (11), Kisii Central (10) and Etago (7).
By late December last year, 72 were pending in various courts, while 44 were being investigated. Police were still pursuing at least 10 suspects in relation to some of the murders.
At least 12 people are facing murder charges where four elderly women were lynched in October 2021 on suspicion of practicing witchcraft.
