Leaders in Trans Nzoia differ with governor Natembeya over demolitions
A section of leaders in Trans Nzoia has called out area Governor George Natembeya over the process of repossessing grabbed public properties demanding that he work within the law.
The leaders expressed worry that the County government might be forced to pay millions in legal fees and compensations if the County officers are not following the law during demolitions.
Led by Kiminini MP Kakai Bisauhe, the leaders called for due diligence for due process and procedures to be met before demolitions, especially on prime plots.
“Let the Governor work within the law and engage stakeholders before these demolitions. As leaders we should widely consult and ensure our decisions have goodwill from the public.,” he said.
Already the County government is facing several cases at Environment and Lands Court at Kitale law courts after demolitions at several prime plots including those near Kenyatta Stadium which are set for an upgrade.
On April 19, a property owner went to court to seek an injunction to stop the demolition of her property.
Elizabeth Nasimiyu in her prayers said she had all the legal documents regarding the ownership of the property next to Kenyatta Stadium.
“Such regrettable trend of demolitions of business properties for small-scale and large enterprises have landed our business people into psychological torture, economic suffering, and financial frustrations not-withstanding in the wake of the harsh economic times,” Bisau said.
Speaking in Kitale the legislator said he has no bad blood with the area Governor and noted that he is a critic of public interest.
Former Women Rep Janet Nangabo asked the Governor to stop the demolition and engage with property owners to reduce the loss cost.
She said some properties can be used by the County government with specific compensation to the owners.
However, Governor Natembeya has been adamant assuring residents that he will deal with land grabbers to ensure all public property is repossessed.
Natembeya has been keen to say he is not afraid of legal battles and promised to ensure all that belongs to the public is repossessed.
“Am not afraid of cartels and court cases. They must return what they stole from the public and this will happen under my tenure.” Natembeya said.
The Governor has also cautioned residents against sympathizing with those who grabbed land.
