Law Society protests DCI summons of lawyer Danstan Omari
The Law Society of Kenya Nairobi Branch has condemned the summons issued by the Directorate of Criminal Investigations (DCI) to lawyer Danstan Omari, who represents former Interior Cabinet Secretary Fred Matiang’i.
Omari was asked to appear before the DCI on Monday, February 22, 2023, over his claims that police officers raided Matiang’i’s home in Karen on Friday night.
The LSK Nairobi Branch said that the summons were meant to intimidate, threaten and prevent Omari from discharging his duties as an advocate and an officer of the court.
The lawyers said that they were outraged and apprehensive about the environment in which Kenyan lawyers have to practise, as they face intimidation from external forces that attempt to limit their right to representation and expression.
“We are outraged and apprehensive about the environment in which Kenyan lawyers have to practise. The Advocate’s security is now in question as the body which is meant to work with the lawyers in dispensation of justice is now exerting undue pressure to frustrate the existing Advocate-Client
relationship between the said Advocate and his client, Dr. Fred Matiang’i,” LSK Nairobi Branch chair LSK, said.
They demanded that the DCI respect advocate-client privilege and stop using alleged offences as tactics to cause fear and trepidation among lawyers.
They also called for an end to harassment and killings of lawyers in Kenya, citing cases such as Willy Kimani, Jared Ratemo, Stephen Mburu and Antony Ngunjiri.
The LSK Nairobi Branch further demanded that the Government of Kenya with all relevant authorities take appropriate and immediate measures to protect advocates and channel efforts towards access to justice.
Namisi called on members to turn up at the DCI Headquarters on Thursday as a sign of solidarity with their besieged colleague.
Omari has dismissed the summons as baseless and said that he was only doing his job for his client.
