Law Society of Kenya sues government over flood crisis
The Law Society of Kenya has taken the government to court over the floods that have wreaked havoc across the country.
On Friday, May 3, the High Court ordered the government to produce evidence of its plans to contain the deaths and destruction caused by the floods or measures it has taken to prevent and control further loss of life and property as a result of the ongoing flooding in the country.
Nakuru High Court judge Samuel Mohochi on Friday issued an ex-parte conservatory order compelling the Cabinet Secretary in the Ministry of Interior and Coordination of National Government to prepare and submit for consideration a contingency plan on the prevention, control and disaster management systems the State has put in place to avert the extreme effects of the ongoing floods, pending the hearing and determination of the case filed by LSK.
“A conservatory order in the nature of a structural interdict is hereby issued compelling the respondents in their respective ministries to prepare and submit to the court for consideration a contingency plan on prevention, monitoring, control and disaster response systems to avoid further loss of lives and property due to the ongoing flash floods, pending the hearing and determination of this application,” Justice Mohochi ordered.
The judge certified the application as urgent and directed that it be served on the respondents within two days from Friday and no later than the close of business on Monday.
The respondents will have three days from the date of service to respond before the inter partes hearing on May 10.
The LSK’s petition comes as flooding continues to wreak havoc across the country.
As of May 4, the government reported that 206,219 people had been displaced from their homes, with more than 72 people reported missing.
A total of 228 people have lost their lives as a result of the ongoing flooding, the Ministry of Home Affairs and National Government said in a statement on May 5.
The government says nine more people have died in the last 24 hours.
In terms of injuries, the government says a total of 164 people have been reported injured.
The government has set up at least 138 evacuation camps in 18 districts for people who have left or been evacuated from flood-hit areas.
The government has also instructed district security committees to work with districts and other stakeholders to coordinate disaster response and to raise public awareness of disaster preparedness.
