Kericho MCAs debate impeachment motion against Governor Erick Mutai
Members of Kericho County Assembly (MCAs) on Wednesday proceeded with debate on impeachment motion against Governor Erick Mutai, despite a court order barring the House from doing so.
The move by 31 out of 47 MCAs comes a day after Justice Joseph Sergon issued an injunction, which prohibited the assembly from continuing the impeachment process until a petition filed by the governor is heard and determined.
The motion spearheaded by Sigowet MCA Kiprotich Rogony was tabled in the assembly on Wednesday, raising questions about whether the House had been duly informed of the court’s injunction.
Speaker Patrick Mutai did not reference the court ruling when the motion was introduced.
Governor Mutai had named the County Assembly of Kericho, the Speaker, and MCA Rogony as respondents in his petition, seeking to halt the impeachment process.
Justice Sergon’s ruling required all parties to file and exchange responses and submissions within 10 days, with oral highlights scheduled for October 15, 2024.
The interim court order remains in place, barring any official action on the impeachment until then.
“The parties to file and exchange their written submissions within 10 days from the date of services of the responses by the respondents,” Justice Sergon ruled.
“Pending the inter partes hearing of the motion dated October 1, 2024, interim conservatory orders are issued against the respondents jointly or severally from suspending and staying the debating considering or acting upon the notice tabled on September 29, 2024 and the motion moved on the September 24, 2024 for the removal of the applicant – Governor from the office,” Justice Sergon directed.
But despite the legal developments, Mr Rogony pressed on with the impeachment motion, which included serious allegations against the governor.
The county boss is accused of gross violation of the Constitution and other laws, acting against the Public Finance Management (PFM) Act, 2012, the Leadership and Integrity Act and presiding over an administration that had seen pilferage of public funds.
Dr Mutai also stands accused of engaging in indecent sexual conduct, thus bringing the Office of the Governor into disrepute.
“There are numerous complaints of the Governor’s indecent and unnatural sexual behaviour by female partners,” Mr Rogony claimed.
Mr Rogony added: “The victim of the abuse seeks anonymity at this stage and the mover of the motion shall, at the hearing of this motion, seek to have the victim heard in camera to protect her identity and dignity…”
On Wednesday morning, Mr Rogony tabled the impeachment motion against the governor and by press time, the debate was ongoing.
“May it go on record that a total of 31 MCAs have signed the register and are present in court,” Speaker Mutai said when the motion was tabled.
