Judiciary issues statement on Lavington land-grab row
The Judiciary has revealed that a piece of land in Lavington that saw authorities arrest an old couple is at the centre of a civil case before the Milimani High Court.
While promising a just outcome, the Judiciary said in a statement that Mahesh and Anita Bhatti sued Malkiat Singh Assi and Munir Ahmed Chowdhary earlier this year, and that the case is still pending before court.
It all started with a video that went viral on the internet. The video that was shared by Kileleshwa MCA Robert Alai showed the police arresting an elderly man, saying they were taking him to the DCI headquarters at Kiambu Road.
When questioned by the family, the police said they didn’t need a warrant to arrest the man.
In another video that went viral online, the daughter of the arrested man said unknown people had entered their residence and started fencing it. She added that she has lived in the residence for 27 years.
The Judiciary stated that the complainants had listed prayers that included the declaration that the applicants have jointly acquired the land title and ownership to the land. They also requested that the Chief land Registrar, Ministry of lands register the applicants as joint proprietors to the land.
The Judiciary clarified that it has not issued any orders or directions in the Lavington land dispute pitting Mr Chowdhary against Mr Mahesh.
“Consequently, no Court Orders have been issued in respect to the properties in question whatsoever. We hope that this statement aids the public in verifying the emerging media reports especially to the extent that touches on the Judicial process, “ the Judiciary said in a statement.
The arm of the government also asserted that the case is set to be mentioned on September 18.
This comes a day after the Directorate of Criminal Investigations came out to defend the family accused of attempting to grab the parcel of land.
A letter released by the DCI confirms that the suspect in the matter, the Bahti family, had not provided the investigators with any ownership documents relating to the land dispute.
The accused also came out in public to set the record straight. The accused, Anita Bhati and Baldev Sing Bhati, were taken into custody for alleged land grabbing in Lavington, Nairobi County, on Saturday.
According to Bashir Abdi Rahman, who is an agent and also claims to hold the power of attorney, the half-acre land belongs to Munir Ahmed and the late Malkit Singh, who hold a certificate of title dated December 1, 1971.
The same document holds the date of the sale of half an acre of land to the Bhatti family on August 15, 1988.
The land tussle between the two families is said to have begun on February 28. The tussle caused numerous visits to the police and the Directorate of Criminal Investigations.
The accused, Mr. and Mrs. Bhatti, were released from police custody after paying cash bail worth 50,000 shillings each. The two are expected in court on Monday.
