Judgement in Monica Kimani murder case postponed until December
The high court has postponed the judgment of former TV news anchor Jackie Maribe and ex-lover Joseph Irungu over the murder of late businesswoman Monicah Kimani to December 15.
Justice Grace Nzioka, who was to pass the judgment, cited illness as the reason for the postponement.
The Judge will also be proceeding on leave from November leaving the court with the option of fixing the case for December.
During the closing submissions at the end of the trial, lead prosecutor Gikuhi Gichuhi strongly urged the judge to convict the two defendants. Gichuhi argued that the evidence, supported by witness statements, had proven beyond reasonable doubt that Jowie and Maribe were responsible for Kimani’s murder on September 19, 2018.
Gichuhi emphasized that Jowie had been positively identified by multiple witnesses as the last person seen at Kimani’s residence. This identification was further corroborated by DNA analysis of blood samples found on his shorts.
According to the prosecution’s case, Maribe had conspired with Jowie to fabricate a false narrative that they had been attacked by robbers upon returning to their home at Royal Park Estate in Langata, when, in fact, Jowie had shot himself to conceal his actions.
Gichuhi pointed out that the Government Chemist’s report confirmed the presence of Kimani’s blood samples on Jowie’s clothing, and phone records placed him at the murder scene.
However, Jowie and Maribe, represented by their respective lawyers Prof. Hassan Nandwa and Katwa Kigen, countered the prosecution’s arguments. Prof. Nandwa contended that there was insufficient evidence to prove that Jowie had murdered Kimani and accused the prosecution of relying on a false theory that implicated him solely because he was the last person seen with her.
Kigen argued that none of the witnesses had linked the former news anchor, Maribe, to the murder. He emphasized that the case relied on circumstantial evidence and lacked direct proof against the second accused person, Maribe.
Kigen further informed the court that Maribe had no knowledge of Monica’s existence and emphasized the absence of DNA evidence connecting Maribe to Monica’s murder
