Itumbi wants Matiang’i probed over KES 1.5B Ruaraka land saga
Dennis Itumbi has expressed frustration at the speed in which the Ethics and Anti-Corruption Commission (EACC) is investigating the loss of KES 1.5 billion taxpayers money in the Ruaraka land saga.
In the letter seen by NTV dated 9 February 2023, Itumbi alleges two public primary schools namely Drive In Primary and Ruaraka Primary are situated on public land and ought not to have been compulsorily acquired.
Itumbi claims that despite the directive of the Director of Public Prosecution to include officers from the Directorate of Criminal Investigations and the Land Fraud Department in the investigation of the 26 culprits, including ex-CS Fred Matiang’i, the EACC has failed to produce a water-tight evidence to support the prosecution.
He writes that the EACC has been dragging its feet in the investigation for over three years, with no progress made in the case given his first audience with the commission was on 5 October, 2020.
In his private prosecution application against Matiang’i, the court declined to allow the document produced by the EACC as evidence on the grounds that they did not meet the constitutional threshold.
Itumbi has given the EACC seven days to inform him of the progress made in the investigation, failure to which he will pursue legal action.
