Impasse in PSC membership over supremacy battles

Senate’s failure to consider a motion on the proposed membership to the Parliamentary Service Commission (PSC) has rekindled the protracted sibling rivalry in the bicameral House.

Senate Speaker Amason Kingi’s message from his National Assembly counterpart Moses Wetangula on the list of appointees to the commission by both Houses triggered a backlash between Azimio and Kenya Kwanza senators.

Those proposed for appointment to PSC include Faith Githau (Nyandarua Woman Rep), Mohammed Ali (Nyali), Senator John Kinyua (Laikipia), Senator Joyce Korir (nominated, Mishi Mboko (Likoni), Patrick Makau (Mavoko) and Senator Fatuma Dulo (Isiolo)

Irked senators led by Kisii senator Okongo Omogeni questioned the unilateral decision by the House leadership to drop the proposed names in the Supplimentary Order Paper without members’ consent.

“The tradition of House is that once the Senate Business Committee (SBC) has sat and considered the business to be transacted and placed in the Order Paper, it can only be stood down by the House or a subsequent meeting of the SBC and not to be unilaterally convinced to withdraw the motion before the House,” protest Omogeni.

He questioned, “Why should the Lower House be dedicated to by the Upper House. Why should National Assembly set agenda for this House. We garnered our voters, why are we always playing subservient to the National Assembly is to say the least annoying?

He rose to register his reservations after Minority leader senator Stewart Madzayo also weighed on the matter.

Kingi defended the move, saying he consulted with his National Assembly counterpart Moses Wetangula on the decision to conncurrently table the list in both House and decided otherwise.

He explained to members that he engaged both Madzayo and Minority whip senator Boni Khalwale (Kakamega) concerning the matter after his meeting with Wetangula.

“After our SBC meeting this morning , I updated the Minority Leader on why I engaged Wetangula to ensure we do not operate on cross purposes which was evident if we proceed at the same time,” Kingi told the House.

Omogeni warned the speaker that his actions will kill the spirit of many of them who are very passionate in charging their legislative agenda and serve the senate as an upper House.

He challenged Kingi, “Why cant you convince your counterpart in the national Assembly to allow the senate introduce the motion.”

Senate Deputy Minority leader senator Enock Wambua recalled the discussion they had during their induction in Mombasa on the place of the senate in thee country.

“What pains us that when there is a conflict whether real or imagined, between what the National Assembly should do and senate, we are always invited to give way. We are very deliberate to restore the lost glory of the senate,” charged Wambua.

He argued “ There is nothing that could have gone if we tabled the list concurrently. If our outcomes are difference, there are procedures to remedy the same.”

Senator Khalwale didn’t take the Azimio position lightly, commending Kingi for going at of his way to consult both parties on the mater despite the availability of provisions to resolve the same.

“A commission serves the sovereignty of a nation. The minority side should not mislead this House and Kenyans that there is a dispute between the senate and National Assembly, is not true.

He asserted, “There is absolutely no disagreement between the two Houses of Parliament, the issue at hand is that the two speakers are going out of their way to assist one of the coalitions’ put its house in order.”

He told off the Azimio side to stop wasting the House’s time.

Nairobi Senator Edwin Sifuna reminded the House that it is the chair who had informed them on the variance in the list.

“That matter did not come from us (Azimio). If indeed the motion will come back in the House, it should come back in the same form as it appears in the Order Paper. The speaker told us If Senate and National Assembly proceeds simultaneously they will end up with different names.

He added, “We will deal with demons. We are going to fight against greed, impunity and massacre greed in this House by the leadership.”

Kingi also conveyed a resolution passed by the National Assembly on Thursday 3rd November, pursuant to the provisions of Article 5 to the protocol of the treaty establishing the Africa community and regional parliament.

He therefore sought the senate’s concurrence for the approval for appointment of senators Prof Margaret Kamar (nominated) and Danson Mungatana (Tana River), and Member of the national Assembly Rahab Mukami( Nyeri Woman Rep), Esther Passaris (Nairobi woman Rep) and Majimbo Kalasinga (Kabuchai).

“I urge the senate to consider the approval and further in an appropriate time convey the decision of Kenya to the president of the pan African parliament accordingly,” said Kingi, explaining that the matters had been deliberated in the Senate Business Committee (SBC) and a notice of motion to be issues.

Kingi explained that the pan African parliament is one of the organs of the African Union, that is consultative and advisory.

“This is a place to ensure full participation of the people of Africa in the development of economic integration,” stated Kingi.
