Gang attempts to evict family of former MP from Kileleshwa home

A gang on Tuesday attempted to evict the family of former nominated MP Hassan Osman from their home located in Keleleshwa along Kandara Road.

The group of rowdy youth armed with blunt objects and machetes stormed the compound while the family was busy preparing for the day and were demanding them to get out.

This happened despite the family having a court order which stated that they should remain as the owners until the court decides on the matter. The court order was issued by Senior Principal Magistrate P.K Rotich.

“We have a court order which was issued by the courts and it clearly states that we should remain here. Who is this person so powerful that they cannot even respect such orders?” pose Hassan Noor who is the family’s spokesperson.

He said that for days they had been receiving unexpected visitors who were threatening the family to leave the compound because another investor had taken over the property.

When the gang arrived at the home of Osman they encountered police officers from Kileleshwa Police Station who arrested them.

However, hours later, the suspects who had arrived in a pick-up of registration number KAT 225N were released in unclear circumstances.

Documents in our possession reveal that the political leader’s family had stayed in the property for 13 years and that they had a lease that was scheduled to expire in 2027.

In a letter by the family’s lawyer Weyombo Mwalakha addressing the OCS Railways Police Station, the police were accused of asking a team of militia who were dressed in plain clothes to cause chaos at the property.

“We are reliably informed that you command a gang of militia dressed in plain clothes, armed with crude weapons, and under your directive, they intend to break into our client’s property tonight to cause havoc and destruction and to erect an illegal structure, while it is within your knowledge that there is a valid court order in force barring the same, it also within your knowledge that the property is outside your area of jurisdiction,” the statement read in part.

The lawyer also said that they were well informed that the gang had been harassing and intimidating members of the public occupying the property and others were even impersonating officers attached to the Directorate of Criminal Investigations (DCI).

“We wish to remind you that you took an oath to obey the Constitution of Kenya and all laws that govern this country. Therefore, you are not above the law or an exception to the law. Your actions amount to abuse of power and the office you hold. You will be held accountable for your actions as an individual,” the letter further read.

The Nation is also in possession of letters penned by the office of the Director of Public Prosecution (ODPP) to Inspector General of Police Japheth Koome asking his office to give out the investigations file on who is the owner of the property.

However, in a follow-up letter penned nine months after the first one, the ODPP said that they were yet to be issued with the file so as they can issue recommendations.

“Reference is made to our letter dated March 24, 2023, which has not elicited any response from your office so far. Kindly, forward the investigations file with the outcome of your investigations to our office for perusal and directives,” the most recent letter addressed to IG Koome on the matter read in part.

In addition, another letter was penned by the Internal Affair Unit within the National Police Service (NPS) to Regional Police Commander Nairobi County Adamson Bungei which raised concerns about police inactiveness on the matter.

On October 27, 2021, their clients were offered a six-year lease by the Kenya Railways Cooperation (KRC) on the property.

The letter revealed that in January 2023, KRC sent two of its officials who went to the property and threatened Omar and his wife Ms Fatuma Abdullahi.

It said that a report on the threats that were issued to the family was made at Kileleshwa Police Station on the same day and recorded under Occurrence Book (OB) number 12/12/01/2023.

Other reports made on the same matter include; OB number 12/08/2023, when KRC officials raided the home and made away with computers, Television sets, a heavy duty printer, scanners, cameras and two motor vehicles.

The other is OB number 12/04/03/2023, KRC staff stormed the property and assaulted Ms Fatuma Abdullahi who reported the matter but to date nothing has been done.

OB number 09/10/03/2023- KRC officials also stormed the property and vandalized it but to date, the matter has never been investigated.

“Despite the OCS Kileleshwa Police Station having a duty as per Chapter 56 of the Service Standing Orders (SSO) to inter alia ensure that all complaints received are properly recorded and investigated, efforts to follow up on the progress of the above-quoted cases by Hassan Omar and Fatuma Abdullahi have been fruitless,” the statement read in part.

The Internal Affairs Unit asked Bungei to ensure that a brief is handed over to the office of IG Koome but this has never happened to date.
