Five reasons Meru MCAs want Senate to uphold Mwangaza impeachment

Senate committee has highlighted five charges in which grounds Meru Members of County Assembly asserted to oust governor Kawira Mwangaza.

During the first sitting on Tuesday, the committee presented the list of charges as part of its investigation into the impeachment of the governor.

If the claims made against her are deemed to be credible, the committee will either uphold the Meru MCAs’ decision to fire the county boss after barely four months in office.

During the opening of the hearings, Mwangaza denied all the allegations.

The charges are summarised as follows;

Nepotism, Illegal Appointments and Unlawful Dismissals 

Mwangaza is accused of having appointed her husband without holding an open and competitive hiring process to county offices, including the vacant positions of Meru Hustlers Ambassador and Patron of the Meru Youth Service. Mwangaza is also accused of reappointing Rufus Miriti as County Secretary without the Assembly’s consent.

Additionally, Mwangaza is accused of appointing unqualified people, such as Hillary Sandi as director of communications, Earnest Mutembei as director of monitoring and evaluation, Munene Samaritan as director of special programs, and Henry Mzungu as director of administration.

Incitement, Bullying, Vilification and Misleading Campaigns Against Other Leaders

The governor is accused of bullying and inciting the public against the Minority Leader, demanding a public apology from the Minority Leader, and falsely accusing members of the assembly and other elected leaders of cartels, blackmail, greed, corruption, and intimidation.

In addition, the governor is accused of inciting the public against the Minority Whip, falsely accusing the Minority Whip of “stoning,” and falsely accusing members of the assembly and other elected leaders of cartelism, blackmail, greed, corruption, and intimidation.

The governor is also facing charges related to vilifying the Senator of Meru County, falsely accusing the Senator of demanding a share of county government appointments and creating a wedge between the Governor and the President of Kenya, and falsely accusing the Senator of cartelism, blackmail, greed, corruption, and intimidation.

Mwangaza is accused of vilifying the Cabinet Secretary for Agriculture, falsely accusing the Cabinet Secretary of being behind a plot to kill the governor, and falsely accusing the Cabinet Secretary of cartelism, blackmail, greed, corruption, and intimidation.

Forceful Entry into the Assembly Precincts and Mobilisation of Unlawful Riots Against Members of the Assembly.

On October 19, 2022, the governor and her husband allegedly violated Articles 10, 73, and 75 of the Constitution, as well as sections 5 and 7 of the County Assemblies Powers and Privileges Act, 2017.

They are accused of forcefully entering the assembly precinct, and falsely accusing members of the assembly and other elected leaders of cartelism, blackmail, greed, corruption, and intimidation.

Additionally, the governor is accused of organizing a violent demonstration against the members of the assembly at the assembly precinct and addressing a riotous crowd at the precinct.

Violation of Public Finance Management Laws

The charge, which dates back to September 2022, alleges that Mwangaza violated several laws, including the Constitution and the Public Finance Management Act, by directing the Meru Teaching and Referral Hospital to spend all revenue at source and issuing waivers on fees without proper authorization.

Mwangaza is also accused of directing county government officers to further the interests of Baite TV, a media station owned by a private company connected to the governor.

Misconduct Relating to Nomination of County Executive Committee Members.

In November 2022, Mwangaza is accused of gross misconduct and violating various laws, including the Constitution and the Public Appointments Act, by vilifying members of the county assembly and falsely accusing them of short-changing certain nominees for appointments to the county executive committee.

Mwangaza is also accused of illegally instructing a nominee to take control of the statutory functions of a retention enhancement fund committee, failing to submit additional names for appointment to the county assembly, and reorganizing her government in a way that caused wrangling within the assembly.
