DPP orders Ipoa to take over Nakuru club shooting case

The Directorate of Public Prosecutions (DPP) has directed the Independent Police Oversight Authority (Ipoa) to take over investigations into the Nakuru nightclub shooting, in which a police officer is accused of killing two people and injuring two others at a club in Nakuru.

Senior Assistant DPP Hassan Abdi confirmed that he had issued a directive to the Ipoa to take over investigations from the police, who were handling the matter.

“I have directed the Ipoa, which is the constitutional body mandated to carry out investigations involving police officers. Once they are done with the investigations they should bring back the file for directions,” Abdi said.

This comes as the court adjourned the matter to next Friday when a decision will be made on whether or not to charge Nicholas Musyoka Musau.

Musyoka, an officer attached to Nakuru Central Police Station, is accused of shooting and killing Ann Maina on the night of December 13, 2023 at Lorita’s Liquor House, popularly known as Vegas Club.

The incident unfolded around 3am when Constable Musau was reportedly asked by a waiter to settle his Sh13,000 bill at the club.

A commotion ensued and the officer reportedly fired his gun indiscriminately.

Wambui, 30, died on the spot in the shocking incident while three other people were seriously injured.

They are Benjamin Kote, 27, who was shot in his left lower chest; Edwin Apungana, 33, who sustained two gunshot wounds on the upper abdomen; and Laura Kwasira, 31, who suffered multiple gunshot wounds on the pelvis, abdomen and chest.

Kwasira, a PhD student and lecturer, later died of her injuries at Nakuru Level Five Hospital.

Constable Musau has been in custody at Kaptembwo Police Station since December 14 after the court granted the police seven days to continue detaining him while they complete investigations.

When the case came up before Principal Resident Magistrate Isaac Orenge on Thursday, the prosecution said it had not yet received any instructions from the police station regarding the case file.

The officer was neither physically nor virtually present in court when the case was mentioned.

However, he was escorted into the courtroom by the police a few minutes after the court went on a break.

He covered his head with a Maasai shuka and wore sunglasses and a mask.

Attempts by investigating officer David Kariuki to get the court to deal with the matter proved futile after the court assistant informed them that the matter had been adjourned.

The court ordered them to appear before it on Friday.

Meanwhile, emotions ran high at the burial of Wambui, one of the victims of the shooting.

Wambui, a nightclub attendant, was buried at her home in Nyahururu on Thursday in an emotional send-off attended by family, friends, work colleagues and neighbours.

Relatives condemned the attack and demanded justice.

“We want the government to ensure the person who killed our sister is tried and punished. She did not deserve to die a painful death. She has left behind three children,” said Peter Gachie, Wambui’s brother.

“What happened will remain etched in our minds forever. We lost an innocent life and the offender should not go unpunished.”

Colleagues described Wambui as a loyal, hardworking, and outgoing person who related well with everyone at work.

A postmortem revealed that she died of massive blood loss from a single gunshot wound to the chest.
