Court finds Egerton University VC in contempt over tutors’ salary deduction
Nakuru Environment and Labour Relations Court has found Egerton University vice-chancellor Isaac Kibwage, and eight council members guilty of contempt for failing to pay lecturers full salaries.
Kibwage and his council are said to have ignored court orders issued in May this year, stopping the continued deduction of the salaries of its staff who are members of the University Academic Staff Union (UASU) as punishment for taking part in a strike in 2021.
In his ruling today, Justice David Nderitu said, “It is the considered view of this court, that all the respondents jointly and severally, and individually have willfully, blatantly, and deliberately failed and refused to obey court orders issued by this court on May 30, 2022, and no reasonable reason has been given,”
The ruling came as lecturers accused the university council and VC of impunity by disregarding court orders arguing they had failed to appear in court as ordered through summons issued on November 17.
Egerton administrators and lecturers have been feuding in court over the deduction of salary payments following the university’s decision to slash their salaries by half as punishment for their industrial action.
In his May ruling, Justice Nderitu said the university had illegally deducted substantial amounts of money from its members’ salaries occasioning financial prejudice in the face of the current economic hardships.
In December last year, Treasury told Parliament that Egerton University needed KES 1.3 billion to break even. The university like many other public universities has been facing financial troubles that have threatened to stall academia.
