Court dismisses bid to block EACC from recovering grabbed Sh2.4B Moi International Airport land
The Mombasa-based Environment and Land Court has dismissed a case filed to block EACC from recovering public land worth Sh2.4 billion that was grabbed from Moi International Airport.
The grabbed airport land includes a portion of the Moi International Airport runway, a UN support facility, and a Kenyan military base and its watch tower.
Justice Stephen Kibunja also dismissed the case seeking to block the recovery of Sh948 million illegal compensation made by the National Land Authority (NLC) in the compulsory acquisition of land for the construction of the SGR and the Dongo – Kundu Kipevu Road Project in Mombasa.
In the ruling on Wednesday, July 12 Justice Kibunja stated that the initial objection made by NLC CEO Tom Aziz Chavangi lacked credibility.
Following the ruling, the EACC lawsuit to reclaim the illegally compensated Sh984M and the land that was illegally taken for the Mombasa Airport will proceed toward a more logical end.
The defendants including Chavangi objected to the EACC lawsuit, claiming that the issues stated had already been addressed by legal channels
The EACC sued the Mombasa-based East African Gas Company Limited alongside eight other parties, including the former managing director of the Kenya Airports Authority (KAA) and registered owner of the grabbed parcel of land, Peter Kipyegon Lagat, the former commissioner of land, Wilson Gacanja, the former CEO of the National Land Commission (NLC), Tom Aziz Chavangi, and the former director of valuation of the NLC, Salome Munubi.
The sued directors of the East African Gas Company include Kipkurui Kimosop, Caroline Jebet Kigen, and Joshua Chelelgo Kulei.
