Starting today, public hearings on petitions for the removal from office of four IEBC commissioners who contested President William Ruto’s election win will be held by the Departmental Committee on Justice and Legal Affairs.
The hearings are slated to take place from Thursday, November 24, to Tuesday, November 29, 2022, according to a notification released by Samuel Njoroge, Clerk of the National Assembly.
The four petitions submitted to the National Assembly call for the resignation of Vice Chairperson Juliana Cherera, Justus Nyang’aya, Irene Masit, and Wanderi Kamau due to blatant constitutional and oath violations.
The petitions are filed separately by the Republican Party, Geoffrey Langat, Jerry Owuor and Reverend Ndwiga Nthumbi.
The four, according to the petitioners, are not qualified to hold their positions. They want MPs to recommend to President William Ruto that a tribunal be established to investigate the commissioners’ conduct and find them unfit to serve in public office.
They accuse the commissioners of a treacherous scheme in the Supreme Court and swore affidavits based on falsehoods, a fact which the Supreme Court noted in its decision of September 5.
The National Assembly Justice and Legal Affairs Committee has 14 days to determine their viability before reporting back to the House.
Once the committee tables the report, the House will have 10 days to decide whether or not the petitions contain valid grounds for removal of the commissioners.
On August 15, the four commissioners of the Independent Electoral and Boundaries Commission (IEBC) disowned the presidential election results that had not yet been made public, citing the “opaqueness” of the electoral process as their justification.
