Bishop Wanjiru’s church partially demolished in property row with govt agency

A parcel of land that sits along Haile Selassie Avenue where Bishop Margaret Wanjiru’s Jesus is Alive Ministries (JIAM) seats is back to past controversies over a tussle of ownership with the Kenya Railways Corporation.

Unknown persons forcefully gained entrance into the premises on Wednesday and started demolitions claiming that they had been sent by the Kenya Railways Corporation.

Ms Wanjiru who is also a politician linked to President William Ruto’s party, the United Democratic Alliance (UDA), and whose ticket she used to run for the Nairobi Senatorial seat decried that the government had betrayed her.

“I was not campaigning for land grabbers to come and start claiming that our church properties are their properties,” she said.

While addressing the media, she showed the site affected by the demolition, a wall that stands on the parcel of land and separates Kenya Railways with the compound of the church.

According to the Bishop, the government was involved and that it was a sad state of affairs as it failed to protect the woman of the cloth.

“So definitely the government is involved, and it is sad that this is the government that we campaigned for,” she claimed.

“If people in the Kenya Kwanza government are in a position to demolish her church what can happen to the common mwananchi,” she added.

It is worth noting that on December 6, 2020, President William Ruto while still serving as Former President Uhuru Kenyatta’s deputy visited the church for a fundraiser. He was the chief guest to fundraise in building her multi-million Glory Twin Towers project that by then had stalled for years.

By Wednesday evening, Bishop Wanjiru was still being treated at a city-based hospital where she was joined by family and close allies.

The Government spokesperson Mr Isaac Mwaura did not make any response to the whole matter after being asked to react to the complaints made by the bishop.

The genesis of the woes between the seasoned politician and Kenya Railways Corporation kicked off years back.

Two years ago, a Land Court in Nairobi threw out a case challenging the construction of a wall between Kenya Railway’s land and Bishop Wanjiru’s church.

The case was filed by the Bishop’s church, Rhambai Patel, S&H Investments and Soma Properties suing the Kenya Railways Corporation, Nairobi Metropolitan Services (NMS) and Kenya Urban Roads Authority (KURA).

In their petition, they claimed the ongoing development was blocking their access to Railway Lane, Exchange Lane, Weruga Lane and Haile Selassie Avenue.

They further asked the court to stop erecting the wall. According to the petitioners it would have been important if they were informed by Kenya Railways Corporation of the plan to put up the wall.

In her ruling, Justice Lucy Kimongoi said that JIAM and her neighbors did not prove that the development was encroaching onto their properties.

“The plaintiffs have stated that the wall is being constructed on the first defendant’s (Railways) property. I find that they do not deserve this court’s protection,” ruled Justice Kimongoi, adding that she did not find that the balance of convenience tilts in favour of the first defendant who is the owner of the suit property.

It remains unclear why the demolishers did not also make similar moves to the other complainants who are Rhambai Patel, S&H Investments and Soma Properties.
