Archbishop Sapit to CJ Koome: Is homosexuality no longer a crime?

Archbishop of the Anglican Church of Kenya, Jackson Ole Sapit, has strongly criticised the recent Supreme Court ruling that allows gay and lesbian individuals to register as a lobby group.

He claims that the decision, which allows the LGBTQ community to register as an NGO, is an “attack on creation and the creator himself”.

Sapit argues that the registration of such a group should not have been allowed, as there are no clear articles of association defining the purpose of the LGBTQ community.

While speaking at a function at ACK Church Naivaisha, Sapit revealed he made a call to Chief Justice Martha Koome asking her, whether homosexuality is no longer illegal. According to Sapit, Koome said homosexuality remains outlawed.

I asked the Chief justice and I am asking Kenyans, what are the articles of Association of LGBTQ? Well, we all know that they promote homosexuality. I asked the chief justice is homosexuality no longer a crime?” he said. 

He went on to ask why an outlawed group, such as Al-Shabab or Mungiki, would not be granted registration if a lobby group promoting homosexuality can be registered.

“Then I asked the second question now that you have registered them using the article that Kenya has freedom of association. When bandits in West Pokot want to register Bandit Association, are you going to register them? When Al-Shabab want to be registered an association, are you going to register them? Or Mungiki or any other outlawed group? “

He emphasised that the natural order of God has created men and women to come together, and that going against this order is a ‘fallacy’. He argued that gay relationships do not ‘satisfy individuals’ and are driven by people who wish to pervert the Christian faith.

“So how can we allow ourselves to go against the natural order God does created and pursue things that do not satisfy? Because I don’t think a gay relationship satisfy. It is a fallacy. It is just driven by money and people who want to pervert what Christian faith is all about,”he said. 

Sapit also commented on the recent discussions of removing gender-specific language from the Bible, asking how the stories of figures such as Abraham and Moses could be retold without their gender.

The Supreme Court ruling, which was announced on February 21, dismissed the government’s appeal to prevent the registration of LGBTQ lobby groups.

The court held that the refusal to register such groups violated human rights based on sexual orientation. However, the court clarified that those who contravene the Penal Code, which criminalises “unnatural offences”, will be subjected to sanctions prescribed in existing laws.

The ruling has sparked debate in Kenya, with some leaders, including President William Ruto, opposition leader Raila Odinga, and  Senate Speaker Amason Kingi, vowing to challenge it.
