Aden Duale: Why Azimio does not make up the majority in parliament
Garissa Township MP Aden Duale has said that Azimio la Umoja One Kenya Coalition Political Party legally does not form the majority in the National Assembly as it does not have any elected MPs.
Duale alleges that the Azimio registered as a political party and was entitled to field candidates in the August 9 election, but only fronted Raila Odinga as a presidential candidate.
“Azimio La Umoja OKA political party is registered as a political party under section 7(7 )of PPA 2011 and it was issued with a certificate of full registration. It was, therefore, eligible to field candidates in all elective positions but only fielded for presidential. Azimio La Umoja OKA Political Party, therefore, has no elected members in Parliament,” Duale wrote on his Facebook page.
Duale also claims that Azimio did not qualify for the Political Parties Fund since it does not have any elected members, as required by section 25 of the Political Parties Act, which states that a political party must have at least one elected leader.
Duale also stated that pre-election agreements inked by political parties that have subsequently defected to Kenya Kwanza from Azimio were null and void in law because the agreements were marred with coercion and a lack of free will on the part of the political parties.
“It is notable that whereas these Parties may have allegedly signed pre-election coalition agreements with the Azimio Coalition, the execution of such agreements was also characterized by coercion and intimidation from security organs,” Duale noted.
Duale contended that the parties who have since formed a pact with the Kenya Kwanza coalition did so legally since they had the right to make political choices.
As the 13th parliament prepares for business following the August 2022 General Election, the two groups retreated this weekend to share leadership positions in the National Assembly and Senate.
Kenya Kwanza chose Kikuyu MP Kimani Ichungwah for the position of National Assembly Majority Leader. In the Senate, Kericho Senator Aaron Cheruiyot has been nominated for Majority Leader to be deputized by his Nakuru counterpart Tabitha Karanja.
For Azimio, Ugunja MP Opiyo Wandayi has been nominated as majority leader and will be deputized by Kathiani MP Robert Mbui. In the Senate, Kilifi Senator Stewart Madzayo has been nominated minority leader, with Kitui Senator Enoch Wambua serving as his deputy.
