Joe Sang’s appointment as Kenya Pipeline MD suspended
The Employment and Labour Relations Court has suspended the appointment of Joe Kimutai Sang as the acting Managing Director of Kenya Pipeline Company (KPC).
The decision was made in response to a petition the Law Society of Kenya filed questioning Sang’s suitability for the job.
Pending the determination of the application, the court has allowed the board to appoint acting an MD from amongst the current employees holding substantive management positions.
The Board of Directors of KPC had earlier this month announced the appointment of Sang as the Acting Managing Director, following the expiry of Irungu Macharia’s three-year contract on January 1, 2023.
The Board had determined that Sang was the most suitable person for the position, based on his performance record with the Company and his experience with the issues and processes at KPC.
Sang’s appointment was contested by the Law Society of Kenya, who argued that he was unsuitable for the position. The appointment of Sang as the acting Managing Director was suspended after the Court heard the arguments and decided in favor of the Law Society of Kenya.
Joe Sang and five former managers were cleared of all charges in the KES 1.9 billion Kisumu Oil Jetty case by the Anti-Corruption Court in December 2022.
Trial Magistrate Victor Wakumile’s decision was upheld by the court, which found that there was insufficient evidence to prove the criminal allegations of abuse of office, undertaking a project without prior planning and the willful disregard for rules governing the management of public funds.
