EACC to freeze assets worth KES 216M owned by KETRACO official

The High Court on Thursday, November 24, granted the Ethics and Anti-Corruption Commission (EACC) orders to freeze assets worth KES 216 million belonging to a senior manager at KETRACO.

Delivering her ruling yesterday, Lady Justice Esther Maina said that the Commission had established a prima facie case with a probability of success to warrant the issue of injunction orders pending the hearing and determination of the forfeiture proceedings.

According to court documents, Peter Maina Njehia, Senior Manager, Supply Chain at the Kenya Electricity Transmission Company Limited (KETRACO) is alleged to have irregularly accumulated wealth totaling KES 278 million.

The documents further revealed that between January 2010 and March 2021, during which period Njehia acquired assets worth KES 278,049,625.39 against his known total legitimate income of KES 40,242,855.99 for the said period resulting to an assets disproportion of KES 237,806,769.40.

In their fillings, EACC alleges that at the time of the acquisition of these assets, Njehia had received funds from individuals and institutions that had secured tenders with his employer, KETRACO.

“In one instance, Sieyuan Electric Company Limited which had been awarded a tender by KETRACO deposited a total of KES 3,000,000 in two bank accounts belonging to Njehia’s spouse,” EACC said in a press statement.

Similarly, Njehia is said to have received KES 400,000 and KES 85,000 respectively from Jooyato Surveys Limited and Jacob Oyato, a Director of Jooyato Surveys Limited at a time the said company had been awarded several contracts by KETRACO.

The corruption watchdog indicted Njehia after he failed to comply with a demand issued on September 14, to surrender unexplainable assets worth KES 216,374,181 frozen by the court.

Njehia had responded on May 17 to a request by EACC to explain the disproportion in his assets with his known legitimate sources of income, however, EACC says, “After analysis of cumulative assets, some assets valued at KES 21,432,587 were found to have been satisfactorily explained leaving out an unexplained disproportion of KES 216 million.”

The court ordered that any activity in 35 land parcels worth KES 78.5 million, nine vehicles for KES 19.5 million, and KES 76 million kept in three bank accounts be halted.

Two Safaricom lines with Mpesa transactions totaling KES 15 million, a total investment in Saccos totaling KES 73.9 million, a total investment in FEP holdings totaling KES 1 million, and shares totaling KES 171,391.
