Court suspends vetting of nominated CECs in Nakuru County
The vetting of county excutive committee members nominated by Nakuru Governor Susan Kihika has been halted by an Employment and Labour Relations Court following a complaint by a county resident who accused the governor of breaking the law while releasing the list of nominees on October 13.
According to Benjamin Magare, a Nakuru-based specialist trauma and general surgeon, the list of County Executive Committee (CEC) members does not reflect the county’s ethnic and cultural variety, which is contrary to the County Government Act and the Kenyan constitution.
“The appointments should be declared illegal, null and void and quashed by the court,” he said.
One of his allegations is that the list has seven nominations from one community, two from another, and only one from a third, leaving out 40 other localities.
Kihika has nominated Dr Nelson Tanui (Water and Environment), Dr Samuel Mwangi (Health), Stephen Muiruri (Trade, Culture and Tourism), John Karanja (Land and Physical Planning), Leonard Kipkoech (Agriculture), Roselyn Wanjiru (Public Service Management), Josephine Atieno (Sports, Gender Culture and Social Services), Zipporah Wambui (Education, Youth and ICT), Stephen Njogu ( Finance and Economic Planning) and Michael Kamau (Infrastructure) as the people who will help her implement her manifesto.
Magare saw the exercise as biased because two communities accounted for 90 percent of the positions.
The petitioner claimed that the nomination process was not fair, open, competitive, merit-based, or inclusive, and that it lacked integrity, competence, and fitness.
“Pending the hearing and determination of an application challenging the appointments, an interim order is hereby issued suspending any other document that notifies of the nomination for appointment of the 10 as CECs,” the court ruled.
The court directed that the orders be served on the governor, the county government, the county assembly, and the nominees, awaiting the October 31 inter-parties hearing.
