Court date set for Gatundu South MP over shooting
Gatundu South MP Gabriel Kagombe, who was arrested on Friday, May 31, at his Nairobi’s Kileleshwa home over allegations of misuse of a firearm and killing of a boda boda rider David Nduati, will be arraigned at Kiambu Law Courts on Monday June 3, where the prosecution team will be pushing for murder charges against him.
The prosecution will also be pleading with the court to have him detained for more days to conclude investigations.
The legislator is said to be currently locked up at Pangani Police Station, from where he was taken after being booked at Kamukunji. Police spokesperson Resila Onyango has confirmed Mr Kagombe arrest but was hesitant to divulge further details.
“Yes, he is in police custody but allow me to ask the office of Director of Public Prosecutions the details you are asking about because I don’t have them now,” Ms Onyango told Sunday Nation.
However, she had not responded by the time of going to press. The arrest of Mr Kagombe was arrived at after detectives from the Directorate of Criminal Investigations conducted ballistic investigations on all firearms that were at the scene when the incident happened. It was ascertained that the gun which discharged the bullet was Mr Kagombe’s official firearm.
Mr Kagombe’s troubles began when on May 17 the legislator together with National Assembly Majority Leader Kimani Ichung’wa (Kikuyu), Elijah Njoroge (Gatundu North) and Ngoliba ward MCA Joachim Njama accompanied Thika Town Member of Parliament Ms Alice Ms Ng’ang’a to launch the construction of Sh 55 million in Kiganjo market in Kamenu Ward when two camps brawled.
On June 1, Mr Njama was grilled by DCI officers at their Kiambu Road headquarters.
Trouble started Thursday, May 16, when Kamenu Ward Rep Peter Mburu mobilised his supporters and allocated them a space and immediately embarked on erecting makeshift market sheds.
On May 17, Ms Ng’ang’a turned up with her own supporters and a contractor to commission construction of the market claiming it was a project of the National government rather than the county government and that Mr Mburu had no authority to allocate any portion of it.
The two camps would then engage in running battles, many of them brandishing machetes.
Mr Mburu and his supporters maintained that the proposed market was the County Government of Kiambu’s brainchild while Ms Ng’ang’a insisted it was a project of the National government that was being implemented on the strength of President William Ruto’s earlier promise during his campaign for office.
As two camps clashed, Mr Kagombe is captured in an amateur video removing a handgun from his waistline and shooting, as the crowd scampered, screaming.
In the melee, Mr Nduati [whose body has since that day been lying at General Kago Funeral Home], was hit and died.
Police have been investigating to determine whether a bullet discharged from Mr Kagombe’s gun killed Mr Nduati.
