Trouble in the air: KAA workers down tools hours after KQ pilots
Just hours after Kenya Airways pilots began their industrial action on Saturday, Kenya Airport Authority Union workers are set to follow suit further threatening to paralyse the country’s air transport.
In a statement by the Kenya Aviation Workers Union (KAWU) dated November 5, Secretary General Moss Ndiema directed its members that include cabin crew and ground staff to proceed on strike, citing the failure by the Kenya Airport Authority management to honour the existing Collective Bargaining Agreement negotiated and agreed upon in 2019.
According to Ndiema a court order issued on August 15, this year had given KAA workers the go ahead to proceed on strike should KAA refuse to comply with the court directives requiring them to conclude negotiations on reduced pay increases with airport workers within 10 days.
“Pursuant to the said court order, this is to instruct and advice all unionisable employees at KAA to commence the strike at 2 pm today, November 5, 2022, in compliance with the court order,” he said.
Lady Justice Monica Mbaru in her ruling in August said, “The claimant has the next 10 calendar days to conclude the CBA with the respondent and serve the minister and a copy to the court,” adding that, “Where the claimant is unable, unwilling or refuses to comply or address, the respondent shall be at liberty to commence industrial action and only have the 55 union officials present.”
KAA moved to court appealing the decision in an effort to stop a planned strike. The legal battles between KAA and KAWU have been going on since early this year.
In April, KAWU issued a strike notice over the same, but KAA moved to court to bar the strike. In May, Justice Mbaru issued orders barring the aviation workers from going on strike until a suit that was filed by KAA is dispensed with.
In their suit, KAA argued the planned strike was illegal further adding that a strike would have a devastating effect on the economy and the entire aviation industry.
In a pact whose execution has been delayed in part by Covid-19 delays, the union is asking to be granted a basic pay boost of 13 percent for the term of the Collective Bargaining Agreement (2016-2019) in addition to an annual hike.
For the KAA Board, they suggested raising the salaries of those who are eligible for unionisation by 6% per year from 2016 to 2019. The action was taken to protect the authority’s limited financial resources.
Ndiema disagreed, claiming that despite the fact that the two sides had agreed on a basic wage hike of 7 per cent for employees in 2016, 7 per cent in 2018, 2 per cent in 2018, and 2 per cent up until June 2019, KAA had drafted their own CBA and chosen to cut basic pay by 1 per cent to 4 per cent.
The union says, they will only return to work once the terms of the 2016 CBA are satisfactorily resolved.
