Nairobi County Assembly MCAs sworn in amid heightened security

The Nairobi County Assembly has this morning sworn in, its 124 members amid heightened security.
The Ward Representatives will then vote for their preferred Speaker to pave way for the house business.

Only two candidates are in the race for the Nairobi speaker’s seat. On Wednesday, the County Assembly Clerk Edward Gichana confirmed only Kennedy Ng’ondi and Hassan Robow fully met the requirements as per the gazette notice.

Despite 24 people collecting forms to contest for the seat only nine got consideration.

Benson Mutura, the speaker of the Nairobi County Assembly, was unexpectedly disqualified from the campaign for failing to submit a certificate of good conduct.

According to the clerk, the Assembly’s technical committee, Mutura and seven others did not meet the set requirements. Others who were locked out include Brian Mutie, Ahmed Subanea, Arthur Ndung’u, Samuel Mokua, Ooko Okello and Charles Kio.

As a result, some MCAs linked with Kenya Kwanza opposed Mutura’s elimination from the contest, accusing the clerk of breaching the law.

Kenya Kwanza Youth leader Samwel Masaki who was also eyeing the seat has lamented on his social media pages, over his disqualification alleging the Clerk may have been compromised to edge out contestants.

“The clerk of the Nairobi County assembly was compromised to intentionally block my candidature after issuing all my documents on time and having received all copies. He said in his statement I only attached invoice receipts for good conduct which by law is valid and allowed. I remain loyal to my President and My county Governor”

The legislators, led by Waithaka MCA-elect Anthony Kiragu, have pledged to prevent the swearing-in ceremony if their preferred candidates are not let to run for office.

“We want to promise that there will be no swearing-in ceremony and any other activity if this illegality is allowed to go on,” Kiragu said.

The election of the speaker is required by law to happen right away following the oath-taking of the MCAs.

Additionally, according to the standing orders, the election of the speaker and the swearing-in of new members would be the only two things on the order paper for the first sitting.

The standing orders state that “a speaker should be elected at the first meeting of the county assembly after a general election and before the county assembly dispatches with any other business, except the administration of the oath or affirmation of office to members present.”

The speaker’s responsibilities include presiding over county assembly debates at each meeting and keeping track of the assembly’s attendance, orders, and any applicable laws as well as assembly customs, traditions, and practices.

Besides being the spokesperson of the assembly, the speaker ensures the dignity of the assembly is upheld and disciplines MCAs for misconduct, among others.
