Osoi and ‘Cop Shakur’ to remain in custody for seven days
Ex-serviceman Patrick Osoi and former prison warden Jackson Kihara will remain in custody until next week awaiting a ruling on whether they will be freed on bond.
The two are being investigated over claims of preparation to commit a felony and engaging in activities prejudicial to public order and the police had asked the court to allow them to hold the suspects for two weeks, pending conclusion of investigations against them.
Kahawa Law Courts magistrate Gideon Kiage said he will rule on the application on August 7, after the defence lawyers opposed the application to detain the two.
The court directed Mr Osoi be held at Muthaiga Police Station while Mr Kihara alias ‘Cop Shakur’ will be held at Pangani Police Station.
While opposing their release on bond, the prosecution said the two suspects wield considerable influence on social media, where they command large followings.
The court heard that the two could easily sway public opinion or communicate with their supporters in ways that might obstruct justice.
The prosecution further submitted that releasing the suspects at this stage would jeopardize the integrity of crucial evidence and intimidate witnesses.
“The respondents have the potential to interfere with investigations and witnesses. Their release could lead to deletion of incriminating posts and destruction of critical digital evidence,” the prosecution argued.
The court also heard that witnesses are yet to record statements, and there are concerns that they might intimidate or harm them.
The prosecutor also painted the pair as individuals with tactical training and the capacity to use that training to threaten or manipulate witnesses.
They insisted that, given their significant online presence and ability to mobilize followers, Mr Osoi and Mr Kihara could derail the investigation if freed on bond.
However, the defence team accused the State of violating the respondents’ rights.
“Our clients have a constitutional right to be informed of the reasons for their detention,” defence lawyer Duncan Okatch said.
The lawyer questioned the police were yet to prefer charges against the two men.
They further challenged the prosecution’s assertions that the suspects would interfere with witnesses.
“The prosecution keeps saying our clients will intimidate witnesses, yet these witnesses remain unnamed and unknown. How can they interfere with people who have not been identified?” Mr Okatch posed.
In an affidavit, chief inspector Josephine Korir said that they received information on July 28, 2025 that Mr Osoi was planning to wage a war against uniformed police officers.
She added that the suspect was arrested of July 29 on suspicion of engaging in activities prejudicial to the public order, national security, and peace maintenance before, during, and after June 25, 2025 and July 7, 2025 protests.
The investigating officer said Mr Osoi through his X account, has declared forming Fighting Brutality Initiative (FBI) — to mimic the name of the United States’ Federal Bureau of Investigations—and was recruiting former and serving police officers so as to fight illegal orders.
According to the officer, the post raised serious national security implications, adding that a social media post about the said group had attracted a lot of comments and likes, particularly on X.
Investigators revealed that an FBI-linked network central to the probe remains active and is being closely monitored.
