Two nurses charged for pouring acid on police officers during raid
Two nurses accused of splashing acid on three police officers during a raid in Ngara, Nairobi county were on Monday charged with causing grievous harm.
Mr Jonah Kipsiror Marori and his colleague Ephraim Mwaura Karumbi were charged before Milimani Chief Magistrate Benmark Ekhubi with six counts of causing grievous harm and operating a private pharmacy without a licence.
The police officers had raided their facility, Ngara Road Medical Centre, in a crackdown on unregistered clinics.
During the operation at the clinic, which was said to be procuring illegal abortions, the officers were attacked by the nurses. The offence carries a life term in prison upon conviction.
Mr Marori denied three counts of attacking police officers Tom Mbuku, Joyce Otieno and Moses Lelei.
The charge sheet stated that he doused the officers with unknown chemical substances on their faces and hands, causing them grievous harm.
The investigation officer, Deten Saidimu, told the court that the injured officers were admitted to the High Dependency Unit at a city hospital.
“They knocked on the door to be opened and Marori appeared at the door and without any hesitation lased the officers with acid which he splashed on their bodies and clothes causing the three officers to sustain severe chemical burns on their faces, hands and lower limbs,” officer Saidimu told the court.
The police officers raised an alarm and got reinforcement from colleagues at Pangani Police Station, who rushed to the scene and apprehended the nurses.
The court heard that the officers recovered assorted items from the clinic including ‘substances which resemble human organs’ which have since been forwarded to the government chemistry for analysis.
Mr Marori and Mr Mwaura face joint charges of operating a private pharmacy and clinic illegally and being in possession of suspected poison.
The accused persons who have been in custody since November 25, 2024, denied the charges and applied to be released on lenient bond terms or an alternative of a cash bail.
State prosecutor Virginia Kariuki vehemently opposed the release of the accused on cash bail saying the matter was of great public interest and the officers were in critical condition as they suffered serious injuries.
The magistrate inquired from the prosecutor about the degree of burns on the officers.
“The officers suffered chemical burns on their faces, hands and lower limbs. With two officers suffering first-degree burns and are hospitalised,” Kariuki responded.
She added that the assault on the police officers while on duty has raised serious concerns from the National Police Service over the safety of police officers.
“These officers were on their duty when they were attacked. This kind of conduct has caused the National Police to question their safety. Consider this matter as of great public interest,” Ms Kariuki said.
The prosecutor urged the court to consider the serious nature of the assault on the officers.
While pleading for leniency Mr Mwaura urged the court to consider his age which he said is 61 and the millions of shillings he has paid to the Kenyan government in tax as a nurse.
In his ruling, Ekhubi ordered Mr Marori to deposit a bond of Sh600,000 with one surety of a similar amount while Mr Mwaura was freed on a Bond of Sh300,000 with an alternative Sh200,000.
The case will be mentioned on January 20, 2025.
