Kindiki: Chaos at Bomas were an attempted but failed coup d’etat
There is no hiding from the fact that the events at Bomas of Kenya which served as the national tallying center on August 15, 2022, just before the declaration of the president-elect, were shameful and regretful, but they have formed a meal in William Ruto and Rigathi Gachugua’s defence.
As the two mount their defence against the eight petitions levelled against them, Professor Kithure Kindiki took time to remind the nation of the dark images that have come to characterise the 2022 polls.
He compared the chaos at Bomas to the violent mob that stormed the US capital on 6 January 2020, ironically protesting the election of Joe Biden. He says the chaos at Bomas was very well orchestrated and clear, aimed at interfering with the powers of IEBC to declare results following verification.
“Those events and activities amount to nothing short of a fragrant attempt to overthrow the constitution of our country, to subvert the sovereign will of the people of Kenya contrary to Article 1 of the constitution,” said Kindiki.
The chief agent of William Ruto at Bomas, Kindiki, points a figure at the first petitioner whose supporters and agents he says were involved in the chaos and who are yet to even record statements with the authorities.
He further says those events constitute nothing but an attempt to establish a government unconstitutionally contrary to Article 32.
In his summation, Kindiki regrets that the court has no mandate to punish the acts he terms as treasonous. Kindiki said, “This court should stop Barabas from benefitting from his malfeasance.”
In their other arguments, Kioko Kilukumi alleges that the National Security Advisory Council hijacked the four commissioners and used them to try and alter the results of the presidential election.
As for Kiragu Kimani, he reminds the court that the burden of proof is squarely on the petitioners. “It is not enough to say there were irregularities or breaches of the law but that they must demonstrate that there were irregularities and that breaches of such a magnitude affect the outcome. They must be told, to show us where the evidence is,” said Kiragu.
Kiragu further said the petitioners haven’t presented evidence of infiltration hence asking the court to dismiss their petitions.
