Supreme Court strikes out Moses Kuria’s petition, Ruto’s bid against LSK
The Supreme Court has struck out a petition by former Gatundu South MP Moses Kuria saying it has no jurisdiction over the matter. Kuria was seeking to stop the petition by Azimio la Umoja presidential candidate Raila Odinga over the chaos at the Bomas of Kenya.
The court has also dismissed an application by President-Elect William Ruto to have the Law Society of Kenya barred from appearing as Amicus Curiae in the petitions against his win.
The Supreme Court will be holding a Pre-Trial Conference on Tuesday to determine some ground rules where parties will be given an opportunity to introduce themselves on record.
Raila, Ruto and the IEBC have been allowed to have 4 lawyers each while the IEBC Commissioners will have one each. Other petitioners will have two lawyers each.
The court also declined to strike out an application seeking to bar the IEBC Commissioners and Attorney General.
An application by Julius Orenge to be joined as interested party was also dismissed. An application by Agano Parry of Kenya Presidential candidate Waihiga Mwaure to be joined as interested party was also dismissed.
The judges also dismissed an application by Milton Oriku to be joined as interested party.
Applications by John Walubengo, Dr. Joseph Sevilla and Martin Mirero seeking leave to be joined as amici curiae have been allowed.
The court has also allowed an application to admit on record the Replying Affidavits of Juliana Cherera, Justus Nyangaya, Francis Wanderi and Irene Masit.
The International Commission of Jurists Kenya has also been allowed to appear as Amicus Curiae but will only make written submissions.
