Cherera team wanted to illegally force a run-off, Chebukati breaks silence

Independent Electoral and Boundaries  Commission Chairman Wafula Chebukati now says that the four commissioners who broke ranks with the electoral body were working to force a presidential election run-off.

In a statement on Wednesday, Chebukati said that Juliana Cherera, Francis Wanderi, Justus Nyang’aya and Irene Masit demanded that he moderates the results for purpose of forcing an election to a re-run contrary to their oath of office.

“This is tantamount to subverting the Constitution and the sovereign will of the People of Kenya. The Chairperson refused to yield to this unconstitutional and illegal demand and proceeded to declare the results of the Presidential Election as received from the polling stations, and contained in Form 34A, in accordance with the law,” the statement states.

On Monday, the four commissioners issued a statement saying that they could not associate themselves with the results as the process was “opaque”. They later on Tuesday issued another statement saying that the numbers were not adding up and accused Chebukati of running a one-man show.

However, in his statement, Chebukati said that he was empowered by the law to be the National Returning Officer and had to carry out his mandate as such. He noted that all Commissioners were involved in the process and even took turns announcing the tallies in the full glare of the media for six days.

“Their duties were well defined in writing and allocated at the National Tally Center (NTC). They had access to all results beforehand and interchangeably announced them for six (6) days in the full glare of live television,” Chebukati said.

Chebukati further accused the four commissioners of lying and misleading Kenyans when they raise the issue of the alleged o.01 per cent increase in the Presidential Election results. He termed the claims as “false and misleading. ”

“We urge Kenyans to interact with these results and make an objective judgement,” Chebukati said.

According to Chebukati, The 2022 General Election is the most transparent election that the Commission has ever held with all Form 34As uploaded in real-time and made available in the public portal. He added that the original Form 34As were delivered to the National Returning Officer for tallying and verification by the 290 Constituency Returning Officers and 1 (one) Diaspora Returning Officer.

In addition, Chebukati said that agents of all Presidential candidates participated in an elaborate verification process and that 34C which contains the final tallies of all the 46,229 Form 34A from polling stations was uploaded on the public portal for access.

“The Commission also allowed media, observers, candidates and the general public to have access and tally the results announced at the polling stations,” Chebukati said.

He added; “If any of the parties elects to file a petition, it is within their constitutional right and the Commission shall have an opportunity to respond and demonstrate in further detail the circumstances under which the election was conducted, the results verified and outcome declared in accordance with the constitution and the law.”
