Senate approves a special committee to probe Governor Mwangaza’s ouster
The Senate has resolved to establish a special committee to probe the claims that led to Meru Governor Kawira Mwangaza’s dismissal.
33 senators voted in favour of the committee, while two voted against it.
“The committee is expected to report to the Senate within ten days, on whether it finds the particulars of the allegations against the Governor to have been substantiated. The committee should therefore report back to this House on or before Friday 30th December 2022,” Senate Speaker Amason Kingi ordered.
Senate Majority Leader Aaron Cheruiyot made the motion to have the committee investigate Governor Mwangaza, which was backed by Minority Leader Stewart Madzayo.
The proposal to have the matter prosecuted through a committee was opposed by Senator Gloria Orwoba, saying she is not convinced that the selected persons will meet the dynamics of the matter at hand.
“First of all, the impeachment motion of this particular governor touches on a lot of gender issues and when you look at the committee, a committee of 11 people who are going to impeach or not, a woman governor only has 3 women,” she stated.
Busia Senator Okiya Omtatah had also risen on a point of order and faulted the Senate for overstepping on its mandate in regards to impeachment proceedings.
“I’m afraid we are just about to violate the constitution of Kenya, the way previous Houses have been violating the constitution. Impeachment proceedings are a preserve for the presidency,” Omtatah stated.
The committee is likely to meet as early as Wednesday, December 28, to nominate its head and determine how the case would be prosecuted.
It will convene a hearing with both parties. The panel has ten days to submit its report to the House.
If the committee upholds any of the charges in its report to the Senate, the report will be debated and a vote by all 47 elected Senators would be held to determine Mwangaza’s fate.
At least 24 of the elected Senators must vote on four of the accusations to impeach the governor.
If the panel fails to uphold any of the charges, the impeachment would be dismissed and the governor will resume her duties.
Majority Whip Bonny Khalwale (Kakamega), Jackson Mandago (Uasin Gishu), Karungo Thang’wa (Kiambu), and Ali Roba are among the committee members (Mandera).
Esther Okenyuri (nominated), Peris Tobiko (nominated), Eddy Oketch (Migori), Joseph Kamau (Lamu), and Edwin Sifuna are the other members (Nairobi).
Agnes Kavindu (Machakos) and Johannes Mwaruma are also on the panel (Taita Taveta).
Governor Mwangaza is accused of nepotism, illegal appointments, and violating the constitution and the constitutional tasks of county institutions.
The specifics of these charges include her husband’s nomination to county offices and roadside appointments of county personnel in Timau, Nkubu, and Kianjae.
MCAs were accused of cartelization, blackmail, greed, corruption, and intimidation. Governor Mwangaza also accused the ward legislators of orchestrating violent protests at Assembly sessions and breaking public finance regulations.
