Keroche Breweries CEO Tabitha Karanja details KES 14.1 billion tax dispute with KRA
Keroche Breweries CEO Tabitha Karanja has given a detailed explanation to the public over the KES 14.1 billion tax dispute her firm has with the Kenya Revenue Authority (KRA).
The tax dispute dates back to August 2019 when KRA claimed that the brewery had evaded billions in taxes. This led to the arrest of the brewery’s directors in the full view of cameras.
In a statement, Karanja explained that the tax dispute arises from the excise duty paid on the brewery’s Viena Ice Ready to Drink vodka product.
The CEO explained that between June 2015 to June 2019, the brewery used 60.9 million litres of Crescent vodka and added 101 million litres of distilled water from the brewery to make Viena Ice Ready to Drink vodka. Excise duty was paid on the 60.9 million litres of Crescent vodka, but the KRA computed that the 101 million litres of distilled water should also be charged at the rate of KES 120/litre, which amounts to KES 12.1 billion as excise tax, and the resultant VAT of KES 1.94 billion.
Karanja added that the KRA facilitated the brewery with 329 million excise stamps for the packaging of the ready to drink vodka during the period and collected the KES 7.3 billion excise tax for the 60.9 million litres of Crescent vodka used.
The CEO stated that the brewery never charged nor collected any taxes on the distilled tap water used to make the ready to drink vodka for moderate drinking.
Karanja highlighted that the tax dispute has prevented the brewery from getting any funding from any bank in Kenya and internationally, and that it is a hindrance to its operations.
The CEO also expressed hope that the dispute will be resolved through the Alternative Dispute Resolution process, as proposed by the KRA Chairman.
The Chairman, Tabitha Karanja, and Keroche Breweries are obliged to appear in court today for a mention of the same matter, according to a letter Karanja claims she has now received from the DPP via her attorney.
“We read malice and this raises a lot of questions,” she said.
“Our worry is, why now? The timing is wrong because we are currently in negotiations to revive Keroche breweries with financial institutions which are likely to be jeopardized. Instead of hearing Keroche breweries’ cry to be given that enabling environment to restart our brewery, the government institution has continued frustrating and this gives us another blow pushing our financiers even further away,” she added.
